By purchasing an item from Gecko Plastics, you are implying that you understand the agreement and the purchase, and you are accepting the Disclaimer Notice, in addition to the Terms and Conditions. The terms and conditions do not affect your statutory rights.

These terms and conditions apply to all orders places online and telephonically.

Variation
Gecko Plastics may, in its sole discretion, change this agreement or any part thereof at any time without notice.

The agreement:

This agreement is the only agreement between you, the Consumer to whom we are supplying the goods (in accordance with the Terms and Conditions), and us (“we” or “our”), Gecko Plastics. All information on this website is “as is” and excludes all representation and warranties that are related to the website and content (also that provided by third parties). We reserve the right to refuse an order (order = your order of the goods. “Goods” = all products listed in the order.)

The agreement is subject to the Electronic Communication Act 25 of 2002 and contract law in general. The electronic agreement shall only come into effect once Gecko Plastics replied with return communication to confirm such a contract.

Failure of either party to ensure that the agreement is adhered to, shall not imply a waiver of the agreement and will not cause a limitation of any of the obligations mentioned in the agreement. A waiver shall only come into effect when both parties agree to this fact in writing.

This agreement excludes any damages that may result from direct or indirect use of this website to business, computers, data or software, or personal or physical loss. An e-mail shall not be deemed received by Gecko Plastics, until a reply is sent to you. An auto-reply is not considered a response (for the purposes of this paragraph). If the antivirus program blocks your e-mail, it has not been received by the addressee.

Website services:

The services and advertisements provided by the website of Gecko Plastics is not available outside the borders of South Africa unless otherwise stated.

By using the services provided by the website of Gecko Plastics, you indemnify the company, its employees, its affiliates and agents against any damage or loss associated with the website regardless of the way in which it was caused.

Gecko Plastics does not guarantee uninterrupted, error free services. We shall however, try our best to provide consistent services.

Product characteristics:

Since products can be modified, improved or discontinued, we reserve the right to change or edit specifications without notice or prejudice. We do our best to display finish colours accurately, but colour perception is affected by many factors and it can be distorted from person to person.

It is your responsibility to ensure that the goods will fit into your property. Please note that all sizes given are approximate and refers to the sleeping surface only, as supplied by the manufacturer. Comfort indications are for guidance only, and not absolute.

Limitation of Liability

We do not accept any responsibility for damage to your property during delivery other than damage due to our negligence. In such an instance our liability is limited to the direct cost you incurred to repair that damage.

Our total liability in connection with the order, is limited to the value of the goods, whether liability arises from negligence or otherwise.

We shall not be liable for any indirect or consequential losses arising from the order.

Force Majeure

Neither party to the contract will be held liable for any failure or delay in the performance of this agreement for the period that such failure or delay is:

beyond the reasonable control of a party;
materially affects the performance of any of its obligations under this agreement, and
could not reasonable have been foreseen or provided against, but

Will not be excused for failure or delay resulting from only general economic conditions or other general market effects. The party whom experience an unforeseen situation under Force Majeure, will need to inform the other party and must continue with the Terms and Conditions as per agreement.

Customer Privacy Policy

Gecko Plastics shall take all reasonable steps to protect the personal information of users. For the purpose of this clause, “personal information” shall be defined as detailed in the Promotion of Access to Information Act 2 of 2000 (PAIA). The PAIA may be downloaded from: http://www.polity.org.za/attachment.php?aa_id=3569 .

Our Privacy Policy is part of this Agreement, and may change from time to time.

We collect information from you, the user of this site, when you do any of the following:

Register on our site;
Place an order;
Fill out a form.

You supply us with your name, e-mail address, contact number and delivery address.

We use the information you supply for the following purposes:

To better respond to your individual needs (your information will not be sold or given to any other company for any reason without your permission, except to deliver the purchased product or service. This may not include trusted third parties who assist us in operating our website or business, enforce our site policies or protect other’s rights or safety).

We maintain the safety of your personal information by offering the use of a secure, off-site server when you submit or access your personal information. All sensitive payment information you supply is handled by PayWeb – Online Payment Gateway from PayGate, South Africa with MasterCard® SecureCode™ and Verified by Visa™ enabled.

We use cookies (small files that a site transfer to your computer that enables the site to recognize your browser and remember certain information, e.g. the items in your shopping cart).

Our employees are not allowed to accept credit card details for any reason, and must obey all our security policies.

Occasionally, at our discretion, we may include links to other Web sites. These sites have separate and independent privacy policies that may differ from ours, for which we take no responsibility of liability.

By registering on our website you confirm that all information provided is true and that you agree to the Privacy Policy as well as the Terms and Conditions. On violation we may take any action that we deem appropriate.

Updates of this policy may be done from time to time.

Cancellation policy

Our cancellation policy is part of this Agreement, and may change from time to time.

If the order has been dispatched already: – see our return policy.

If your order has not been dispatched yet, cancellation will be done.

In the case of custom made orders, cancellation is only possible if manufacturing has not started yet.

“Cancellation” implies that refunds will be processed within 10 working days after cancellation is confirmed. Payment will be refunded via the same method it was paid originally and into the same account.

Return policy

Our return policy is part of this Agreement and may change from time to time.

Reasonable requests will be dealt with as follows:

Any unused item, still packed in its original packaging as purchased from Gecko Plastics, can be returned within 14 days of the date of delivery.
The product must be in its original condition.
Customized items (design, fabric or colour) cannot be returned.
If Gecko Plastics has to collect the returned item, the Customer is responsible for the full transport costs. Such costs will be deducted from the refund. (Full transport cost may be more than what you paid or what was advertised).
You may exchange an item for another of the same or higher value. If the replacement product is of higher value, you have to pay the difference in price as well as an additional delivery charge. If the replacement item is of lower value, you shall not be entitled to a refund of the difference in price and you still need to pay the additional delivery charge.

Refunds will be processed within 10 working days after the item(s) is received back by Gecko Plastics. Payment will be refunded via the same method it was paid originally and into the same account.

Lead time and delivery

After receipt of payment in our account, delivery will be within 3 working days subject to availability of stock. Please refer to product pages.

Delivery times:

09h00 – 17h00 on Monday – Friday

Please note that it is very difficult to make an appointment for a set time. We will, however, attempt to make a mutually acceptable arrangement.

Delivery dates and lead times are given in good faith but are subject to change.

Cost of delivery

We only deliver free of charge in Rustenburg and surrounding areas for purchases exceeding R300. We can deliver further, although at an additional charge as stipilated below. Please note we currently only deliver to the North West province and maximum distance within a 80km radius from our factory.

3. R250 FLAT RATE (35km-50km from our factory) for orders over R300

4. R325 FLAT RATE (50km-80km from our factory) for orders over R300

5. ALL OTHER LOCATIONS not within our delivery codes will be quoted apon request and a seperate invoice will be issued or original invoice will be adjusted.

Bulk Orders

For bulk orders discount on delivery costs apply, please contact us for more details.

Delivery address

Delivery will be made to the delivery address specified on the order. Any changes to a delivery address must be supported by documentary evidence. Any changes to delivery details must be notified to us at least 24 hours before the arranged date of delivery. Such amendments may postpone the delivery date.

When the goods have been delivered to the address set out in the order and the room of your choice, delivery will be regarded as completed. If the goods do not fit into the required room at the delivery address, you may order a replacement product (see our Return Policy).

We do not need to satisfy ourselves that the person accepting delivery at the agreed address is authorised by you to accept the goods.

Other

Should we be unable to supply the goods for more than 10 working days beyond the delivery date as stated in the order, you will be entitled to cancel the order and get a full refund of all payments unless a mutually acceptable new delivery date can be negotiated.

Risk and responsibility for the goods pass to you once the goods are delivered. Ownership of the goods pass to you on full payment of all costs.

What to do if goods arrive in a damaged condition.

We will do everything in our power to prevent such a circumstance, but because of the human factor, the unforeseen might occur. On the rare occasion of obvious damage on delivery of goods ordered, please follow these easy steps:

Take a photograph as proof
Please indicate the reason for non-acceptance of the goods on the delivery note. Sign and date your comments.
Please phone or e-mail us immediately.
We will arrange for replacement of the damaged parts as soon as possible.

We want satisfied customers. The customer will therefore not be liable for additional expenses regarding replacement. All outstanding issues must be addressed before your order will be regarded as completed. We strive for service excellence.

Payment options accepted

All goods remain the property of Gecko Plastics, until fully paid. Should unpaid products be delivered to you, we reserve the right to claim the money owed to us by using collection agencies and courts. Should this event arise, you will be liable for covering all administrative costs.

We accept the following methods of payment in South African Rand (ZAR):

Card acquiring and security

Card transactions will be acquired for Verntech Enterprises (Pty) Ltd. via PayGate (Pty) Ltd who are the approved payment gateway for all South African Acquiring Banks. PayGate uses the strictest form of encryption, namely Secure Socket Layer 3 (SSL3) and no Card details are stored on the website. Users may go to www.paygate.co.za to view their security certificate and security policy.

Customer details separate from card details

Customer details will be stored by Verntech Enterprises (Pty) Ltd. separately from card details which are entered by the client on PayGate’s secure site. For more detail on PayGate refer to www.paygate.co.za.

Merchant Outlet country and transaction currency

The merchant outlet country at the time of presenting payment options to the cardholder is South Africa. Transaction currency is
South African Rand (ZAR).

Responsibility
Verntech Enterprises (Pty) Ltd. takes responsibility for all aspects relating to the transaction including sale of goods and services sold on this website, customer service and support, dispute resolution and delivery of goods.

EFT

Your order will only be processed after full payment reflects in our bank account. Please use your order number and surname as reference. We request an e-mail of proof of payment for release of your sales order.

Any orders for EFT payment that remains unpaid after three business days, will be cancelled.

It may take up to 3 business days to clear an EFT payment. This delay is not under the control of the merchant.

Direct Bank Deposits

Any orders for Direct Bank Deposit payment that remains unpaid after three business days, will be cancelled.

No international payments will be accepted.

Country of domicile

This website is governed by the laws of South Africa and (Your Company) chooses as its domicilium citandi et executandi for all purposes under this agreement, whether in respect of court process, notice, or other documents or communication of whatsoever nature.

Warranty/Guarantee Info

Because we only stock items made by ourselves, you should not have to use the guarantee/warranty of your purchase. Gecko Plastics displays this information for each item on display. In the unlikely event that it is necessary to fall back on the guarantee/warranty, here is what you should know:

Guarantee:

It is serviced by the manufacturer, Gecko Plastics.
A guarantee is an agreement between the Customer and the Manufacturer that defective or damaged goods will be repaired/replaced (at the expense of the Manufacturer), subject to certain conditions, within a certain time frame, at the Manufacturer’s discretion.
The guarantee covers poor workmanship/ manufacturing faults only, and does not include misuse of the goods or failure to follow manufacturer’s
The guarantee does not cover a defect as a result of poor quality raw material. We purchase only the best raw materials in good faith and we have no control over the manufacturing process of the raw material.
The guarantee does not cover any consequential damages incurred as a result of any failure of our products.
The guarantee is only valid for the original purchaser of the product uon presentation of the proof of purchase.

Warranty:

A warranty is the agreement between the Customer and the Manufacturer that promises to repair/replace the item purchased, within a specified time period. The Customer normally contributes to warranty costs.
The warranty is in effect as soon as the guarantee period has lapsed. The warranty period of an item varies drastically between models and manufacturers. The longer the warranty period, the better the quality of the item (tank). It is not an indication of the lifespan of your tank, but of the quality.
Gecko Plastics will replace/repair the item according to their warranty. If only the lid is faulty , then a new lid only will be supplied. If the tank has failed due to a manufacturing fault then it will be replaced with a new tank of the same size.

How to claim a faulty item:

Please keep your invoice/proof of purchase in a safe place. You will need it for guarantee/warranty purposes. You will not be able to claim without such proof of purchase.
Contact our Customer Care Services with details. In the event of such a claim, Gecko Plastics will assist you to solve the problem as quickly as possible
In case of a replacement under guarantee by Gecko Plastics, Gecko Plastics will deliver a new product and pick up the defective one at no charge to you, the customer.
If your specific tank has been discontinued, it might be necessary for you to re-select another similar item to replace the defective one.
Should your purchase needs to be repaired, it will be collected and re-delivered at no extra charge.
